This Privacy Policy (the "Policy") sets out the basis upon which Regents LED (referred to in this Policy as "we", "us", "our" or "the Company") collects, records, holds, stores, uses, discloses, transfers and otherwise processes personal data relating to individuals who visit, access, browse or otherwise interact with this website, or who submit an enquiry, request or other communication to us by means of any of the electronic forms made available upon it, and it should be read in its entirety and in conjunction with any further notice, term, condition or statement which we may from time to time provide to you at the point at which particular personal data is collected, it being understood that where any such further notice is provided in relation to a specific collection of data that notice shall be read together with this Policy and, to the extent of any inconsistency in relation to that specific collection only, shall prevail over it. For the purposes of the retained EU law version of the General Data Protection Regulation as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018 ("UK GDPR"), and the Data Protection Act 2018 and any subordinate legislation, guidance or code of practice issued thereunder from time to time (together with the UK GDPR, the "Data Protection Legislation"), the Company is the controller in respect of the personal data described in this Policy, meaning that it is the Company which determines the purposes for which and the manner in which any such personal data are, or are to be, processed, and correspondence in connection with this Policy, including any request made by a data subject in exercise of the rights summarised below, any query as to the categories of personal data held, and any complaint as to the manner in which personal data has been processed, may be addressed to us by post at Unit A5 Milland Road Industrial Estate, Milland Road, Neath, United Kingdom, SA11 1NJ, or by electronic mail to info@regentsled.com, or by telephone upon +44 2039 962104, and will in each case be acknowledged and responded to in accordance with the timescales prescribed by the Data Protection Legislation, it being helpful, though not a condition of our responding, for any such communication to indicate at its outset the nature of the request being made in order that it may be directed without delay to the appropriate member of our personnel.

The scope of this Policy extends to this website and to the electronic enquiry facilities made available upon it, and does not extend to personal data which you may elect to provide to us by other means, including without limitation by telephone, by electronic mail sent directly to an individual member of our personnel, by post, in the course of a meeting, at an exhibition or trade event, or through any third-party platform, portal, marketplace or intermediary, in respect of all of which we nevertheless apply standards of handling equivalent to those described herein notwithstanding that the particular procedural detail set out in this Policy is directed to the website. As regards the personal data which we do collect through this website, the position is as follows. The enquiry forms made available upon this website constitute the only facility upon it by which we solicit personal data from you, and the categories of personal data so solicited comprise your name, which is a mandatory field and is collected in order that we may identify the person to whom a response is to be directed; your electronic mail address, which is likewise a mandatory field and is collected in order that a response may be transmitted to you; the name of your company or organisation, which is an optional field; your telephone number, which is an optional field and which is used only in circumstances where you have indicated that a telephone response is desired; the free-text content of the message which you elect to compose, the contents of which are determined entirely by you and are not prescribed, suggested or constrained by us; the classification of the request, being a value determined by the particular form through which the submission was made and denoting, by way of example and without limitation, a request for a product sample, a request for a quotation in respect of a project, a request for lighting design or calculation services, a request that a member of our personnel telephone you, or a request for an appointment at our premises; and, in circumstances only where the submission was initiated from a page of this website concerning a particular product, an alphanumeric product reference which is populated automatically in order that we may identify the fitting to which your enquiry relates. No further categories of personal data are solicited by the said forms and no field is present upon them which is concealed from you or which collects information other than as described in this paragraph. You are requested not to include within the free-text content of any message any special category personal data within the meaning of Article 9 of the UK GDPR, including without limitation data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, genetic data, biometric data processed for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation, nor any information relating to criminal convictions or offences, nor any financial or payment card information, the enquiry facility not being an appropriate or intended medium for the transmission of any such information to us.

Separately from and in addition to the personal data which are collected by means of the enquiry facilities described above, the server infrastructure upon which this website is operated generates and retains, in the ordinary and automatic course of its operation and without any intervention on our part, technical records of the requests transmitted to it, which records include internet protocol addresses, and such records are generated for the purposes only of maintaining the availability, integrity, performance and security of the service, of identifying and diagnosing faults, errors and misconfigurations, and of detecting, investigating and preventing abusive, automated, fraudulent or otherwise illegitimate patterns of access, and are not employed for the construction of any profile of you, are not enriched by reference to any external dataset, are not correlated with any enquiry which you may have submitted or with any other identifier by which you might be recognised, are not disclosed to any third party for any marketing, advertising, analytical, statistical or commercial purpose whatsoever, and are retained only for such period as they remain of utility for the said operational and security purposes, being overwritten and discarded in the ordinary course of the operation of the server infrastructure. This website makes use of cookies and of comparable technologies which store information upon, or gain access to information already stored upon, the terminal equipment by which you access it, and it does so only where you have consented to that storage or access. Upon your first visit you are presented with a notice by which you may accept or refuse; refusal is offered with the same prominence as acceptance and is not made more onerous than it; no storage or access for analytical purposes occurs before a choice has been made; and your choice is remembered so that you are not asked again upon subsequent visits, it being open to you at any time to change that choice by clearing the data this website has stored in your browser through the settings of that browser. The technologies employed are those of Google Analytics, deployed by means of Google Tag Manager, and their function is to allow us to count the visits made to this website, to distinguish one visitor from another so that a return visit is not counted as a new one, to identify which pages are consulted and the routes by which visitors arrive, and to record whether an enquiry was ultimately submitted, so that we may understand which parts of this website are of use and which are not. We have configured that service so that the data it collects is not shared with Google for the personalisation of advertising, and we operate no advertising or conversion tracking pixel, no session replay or heat mapping utility, no social media plug-in or embedded feed which transmits data to the operator of the relevant platform, and no third-party live chat utility. Where you refuse, the measurement technology is instructed, by the mechanism Google publishes for that purpose, not to write to or read from your device at all. The typefaces employed in the presentation of this website continue to be served from infrastructure under our own control rather than being requested from a third-party font distribution service, so that the mere act of loading a page discloses nothing to any third party in the absence of your consent. The obligation arising under regulation 6 of the Privacy and Electronic Communications (EC Directive) Regulations 2003 as amended, to obtain consent to the storing of information, or the gaining of access to information stored, in the terminal equipment of a subscriber or user, is accordingly discharged by the notice described above; and the lawful basis upon which we process the personal data generated by those technologies is your consent, given under Article 6(1)(a) of the UK GDPR, which you may withdraw at any time and the withdrawal of which does not affect the lawfulness of processing carried out before it.

As to the purposes for which the personal data submitted by means of the enquiry facilities are processed, and the lawful bases upon which we rely in respect of that processing, the position is that such data are processed for the purpose of responding to the communication which you have addressed to us and of taking such further steps as may be necessary or appropriate in consequence of it, including without limitation the preparation and transmission of a quotation, the arrangement of the despatch of a sample, the preparation of lighting design calculations, the arrangement of an appointment, the answering of technical questions concerning specification, performance or compatibility, and the performance of any contract which may subsequently be entered into between us, and we rely for that processing upon Article 6(1)(b) of the UK GDPR, being processing necessary for the taking of steps at the request of the data subject prior to entering into a contract, in respect of communications which concern the potential supply of goods or services by us, and upon Article 6(1)(f) of the UK GDPR, being processing necessary for the purposes of the legitimate interests pursued by us, in respect of communications of a general character, those legitimate interests being our interest in responding to persons who have chosen to contact us, in maintaining an accurate record of what was asked of us and of what we answered, and in being able to demonstrate the substance of such exchanges in the event of subsequent query or dispute, which interests we have assessed as not being overridden by the interests or fundamental rights and freedoms of the data subject, having regard to the limited quantity of data concerned, to the fact that the data are supplied to us voluntarily and for the express purpose of eliciting a response, and to the reasonable expectations of a person submitting a business enquiry. We do not process the personal data collected by means of the enquiry facilities for the purposes of direct marketing; we do not incorporate any such data into any mailing list, subscriber list or distribution list; we do not transmit newsletters, promotional communications, product announcements or other unsolicited commercial communications to persons whose data have been collected in this manner; and we do not disclose any such data to any third party for the purposes of that third party's own marketing activity. In the event that we should at any future time determine to establish a facility for the distribution of periodic communications concerning our products, projects or activities, participation in that facility will be contingent upon your having given a positive indication of your wish to participate, such indication being separate from and not bundled with the submission of any enquiry, and it will be open to you to withdraw that indication at any time and without giving reason by means of a single instruction, and neither the giving nor the withholding nor the withdrawal of such indication will have any bearing whatsoever upon the service which you receive from us. No decision producing legal effects concerning you or similarly significantly affecting you is taken by us on the basis of automated processing, and we do not carry out profiling within the meaning of Article 4(4) of the UK GDPR.

Personal data submitted by means of the enquiry facilities are recorded within a content management system operated by us, access to which is restricted to those members of our personnel who have been issued with individual credentials for that purpose and who require access in the discharge of their duties, and no such data are transmitted onward by electronic mail or otherwise to any person outside the Company in the ordinary course of their handling. We do not sell, let, trade, barter or otherwise make available for consideration any personal data to any person. In the operation of this website and of the said content management system we engage a limited number of suppliers of technology services who process personal data on our behalf and upon our documented instructions and who are bound by contractual obligations of confidentiality and security, comprising a provider of cloud infrastructure services, being an established undertaking of international standing, upon whose servers this website and the records of enquiries submitted through it are operated, which servers are situated within the United Kingdom, and a provider of cloud object storage services upon which are held the photographic images, technical drawings, datasheets and similar documents which are displayed upon or made available for download from this website, which storage facility holds no enquiries and no personal data relating to visitors to this website, and we are content to identify either such supplier by name upon request being made to us at the address given above; and, where and only where you have consented to analytics, Google, which provides the measurement and tag management services described earlier in this Policy and which processes information about your use of this website in that capacity. Beyond the foregoing, personal data may be disclosed by us where we are required to do so by law, by a court of competent jurisdiction, or by a regulatory or law enforcement authority acting within its powers, or where disclosure is necessary for the establishment, exercise or defence of legal claims, or in connection with any actual or proposed sale, transfer or reorganisation of the whole or any part of our business, in which last event the recipient would be bound to handle such data in a manner consistent with this Policy. As regards the geographical location at which personal data are held, your enquiry and the technical records described above are held upon servers situated within the United Kingdom and the personal data you submit through the enquiry forms is not transferred to any jurisdiction outside the United Kingdom. Where, and only where, you have consented to analytics, the information those technologies generate is processed by Google and may be transferred to and stored upon servers outside the United Kingdom, including in the United States, under the safeguards Google publishes for that purpose, being the International Data Transfer Addendum to the standard contractual clauses as approved for use in the United Kingdom; refusing analytics prevents that transfer entirely. the photographic and documentary material displayed upon this website is held upon a storage service which may maintain copies of that material in more than one jurisdiction, that arrangement being the means by which such material is delivered expeditiously to visitors irrespective of their location, but that material comprises our own product and project imagery and contains no personal data relating to you, with the consequence that no international transfer of your personal data arises from it.

Personal data are not retained by us indefinitely. Enquiries which do not result in the entering into of any contract between us are retained for a period of approximately two years calculated from the date upon which we last had contact with you in respect of the matter, that period being adopted in order that we may have the benefit of the relevant context in the event that you should revert to us, and upon the expiry of that period such records are deleted; records connected with an order which has been placed with us are retained for a period of six years calculated from the end of our relationship with you, that period being adopted by reference to the periods of limitation applicable to actions founded upon simple contract and to the periods for which records are required to be preserved for taxation purposes, and upon the expiry of that period such records are likewise deleted. Should you wish for an enquiry submitted by you to be deleted in advance of the expiry of the applicable period you may request that we do so and we will give effect to that request save to the extent that we are obliged to retain the record for one of the purposes described above, in which event we will inform you of the position. The security of personal data is a matter to which we attach importance. This website is served over an encrypted transport connection, with the consequence that data submitted by means of the enquiry facilities are encrypted in the course of their transmission to us; the records of enquiries are held within a database which is not addressable from the public internet; and access to those records is contingent upon authentication by means of individually issued credentials. We do not represent that any system is capable of being rendered perfectly secure against every conceivable form of interference, and our approach proceeds from the principle that the most effective protection for information is not to collect it in the first place, which is why the categories of data described above are as limited as they are. In the event of a personal data breach which is likely to result in a risk to the rights and freedoms of natural persons we will notify the Information Commissioner without undue delay and, where feasible, within seventy-two hours of becoming aware of it, and where such a breach is likely to result in a high risk to those rights and freedoms we will communicate the breach to the affected data subjects without undue delay. This website is not directed to children, is not intended to be of interest to them, and we do not knowingly collect personal data relating to any person under the age of thirteen years; should it come to our attention that such data have been submitted to us we will delete them. This website may from time to time contain links to websites operated by third parties, including manufacturers, standards bodies and certification authorities, and we have no control over and accept no responsibility for the content of any such website or for the manner in which the operator of it processes personal data, and you are encouraged to consult the privacy notice published upon any such website before providing personal data to its operator.

The Data Protection Legislation confers upon data subjects a number of rights in respect of personal data relating to them, which rights are exercisable against us as controller and which may be summarised as follows: the right to be informed as to the collection and use of personal data relating to you, to which right this Policy is directed; the right of access, being the right to obtain confirmation as to whether personal data concerning you are being processed and, where that is the case, to obtain a copy of those data together with the supplementary information prescribed by Article 15 of the UK GDPR; the right to rectification, being the right to obtain the correction of inaccurate personal data concerning you and, having regard to the purposes of the processing, the completion of incomplete personal data; the right to erasure, being the right to obtain the deletion of personal data concerning you in the circumstances prescribed by Article 17 of the UK GDPR, which right does not extend to data which we remain obliged or entitled to retain; the right to restriction of processing in the circumstances prescribed by Article 18 of the UK GDPR, including during such period as may be required for the verification of the accuracy of data whose accuracy you have contested; the right to object, upon grounds relating to your particular situation, to processing which is carried out in reliance upon Article 6(1)(f) of the UK GDPR; and the right to data portability in respect of data which you have provided to us and which are processed by automated means in reliance upon Article 6(1)(b), being the right to receive those data in a structured, commonly used and machine-readable format. This Policy may be amended by us from time to time in order to reflect changes in the manner in which we process personal data, changes in the technology employed upon this website, or changes in the applicable law or in the guidance issued by the Commissioner, and any amended version will be published upon this page with the date of its adoption stated at the head of it, such date being the means by which you may ascertain whether the version which you are reading is the version which you have previously considered; where an amendment is of substance we will indicate that fact rather than effecting the amendment silently; and your continued use of this website following the publication of an amended version constitutes your acknowledgement of it.
